1. Definitions and Interpretation

1.1. "RoadMatch" / "We" / "Us" means Malingi Indlovu Group (Pty) Ltd, a private company registered in South Africa, and its trading division RoadMatch.

1.2. "Services" means the vehicle concierge, remote consultation, custom dealer matching, price negotiation, and procurement advocacy services offered through www.roadmatch.co.za.

1.3. "Buyer" / "You" means any natural or juristic person utilizing RoadMatch to source or enquire about a vehicle.

1.4. "Dealership Partner" means any franchised or accredited motor dealership registered within our sourcing network.

1.5. "Google Meet Consultation" means the scheduled online 1-on-1 video or telephonic advisory session provided to the Buyer.

1.6. "Personal Information" bears the exact meaning assigned to it in Section 1 of the Protection of Personal Information Act 4 of 2013 (POPIA).

2. Scope of Service & Regulatory Disclaimers

2.1. Intermediary & Sourcing Agency Status: RoadMatch is a vehicle-buying concierge and dealer matching platform. We are not a motor dealership, physical vehicle seller, credit provider, or registered Financial Services Provider (FSP) under the FAIS Act 37 of 2002.

2.2. No Finance Guarantee: Vehicle finance approval is solely at the discretion of the credit provider, bank, or financial institution handling the application. RoadMatch assists in gathering, structuring, and submitting documentation to bank finance managers but gives no express or implied guarantee of credit approval.

2.3. Stock & Pricing Indications: Vehicle listings or inventory shown on our website represent a non-binding snapshot of stock from our Dealership Partner network. Displayed prices are indicative only and subject to final confirmation, stock availability, and dealer offer updates prior to contract signing.

2.4. Exclusion of Second-Hand Private Sales: RoadMatch services strictly cover vehicles sourced directly through accredited, franchised dealership partners to ensure valid warranties and consumer protections.

3. Digital Consultation, Negotiation & Service Delivery

3.1. Remote Delivery: Consultations and strategy sessions are conducted digitally via Google Meet, email, or WhatsApp/telephonic communication following registration.

3.2. Dealer Negotiation Protocol: RoadMatch acts as your procurement advocate. Upon receiving your budget, vehicle preferences, and specifications, we transmit your request across our Dealership Partner network to secure the best pricing, structure, and terms on your behalf.

3.3. Rescheduling & No-Show Policy: If a Buyer fails to attend a scheduled Google Meet session without giving at least 2 hours' prior written notice, rescheduling remains at RoadMatch's operational discretion.

4. Fees, Payments & CPA Compliance

4.1. Sourcing & Consultation Fee: The Buyer pays a flat R1,500 Sourcing & Consultation Fee upon registration.

4.2. CPA Justification: In accordance with Sections 16 & 68 of the Consumer Protection Act (CPA) 68 of 2008, this fee covers immediate operational expenses, including dedicated consultant allocations, custom database stock searches across partner dealerships, dealer pricing outreach, and 1-on-1 Google Meet advisory sessions.

4.3. Non-Refundable Status: The R1,500 fee is non-refundable once payment is confirmed and sourcing or consultation work has commenced, regardless of whether the Buyer ultimately completes a vehicle purchase at a dealership.

5. Exclusion of Liability & Indemnity

5.1. No Vehicle Warranties: RoadMatch gives no express or implied warranties, representations, or guarantees regarding any vehicle matched, including its mechanical condition, factory specs, mileage accuracy, or delivery timelines. All vehicle condition guarantees, service plans, and manufacturer warranties rest exclusively with the selling Dealership Partner.

5.2. Full CPA Indemnity: Pursuant to the Consumer Protection Act, You hereby unconditionally and irrevocably indemnify RoadMatch, its directors, and employees, holding us harmless against any loss, damage, claim, injury, or legal costs arising from Your use of our website, Google Meet advice, or subsequent transactions with Dealership Partners.

5.3. Third-Party Conduct: RoadMatch is not liable for the conduct, pricing changes, or contractual breaches of any Dealership Partner, bank financier, or insurer.

6. Protection of Personal Information (POPIA & ECT Act)

6.1. Lawful Processing & Limited Disclosure: By submitting details on our website or via WhatsApp/email, You consent to RoadMatch processing Your Personal Information under the Protection of Personal Information Act 4 of 2013 (POPIA). Your information is strictly used to facilitate your vehicle search and finance paperwork with involved Dealership Partners and accredited financial institutions — it is never sold or disclosed for unauthorized purposes. FICA and credit verification documents must be routed directly via applications@roadmatch.co.za.

6.2. Data Subject Rights: In terms of Sections 23 and 24 of POPIA, You hold the right to:

• Confirm what personal records we hold about You.
• Request correction, destruction, or deletion of inaccurate or excessive records.
• Object to direct marketing at any time.

6.3. Information Regulator Details: If You believe Your privacy rights have been infringed, You may lodge a complaint with the South African Information Regulator:

6.4. Electronic Communications (ECT Act): In terms of Section 23 of the Electronic Communications and Transactions Act 25 of 2002, data messages sent between You and RoadMatch are deemed received when electronically acknowledged or responded to by RoadMatch.
